Gender socialization, as one of the most basic types of socialization, affects a person's individual and social life, including the stability of his or her marital life. The aim of this study was to explain the relationship between gender socialization and Divorce between 178 Divorced women and 222 women with emotional Divorce, which was conducted by survey method in Bandar Abbas. This study used biological and social theories to explain gender socialization and theories of structural functionalism and the love triangle to explain Divorce. In the present study, simple and stratified random sampling proportional to volume was used for women with emotional Divorce and chain sampling was used for Divorced women. Questionnaire data were collected through interviews and face validity was confirmed through literature review and expert judgment, structural validity was confirmed by factor analysis and its reliability was confirmed by Cronbach's alpha. The results showed that gender socialization of 29.4% of Divorced women and 70.6% of women with emotional Divorce is traditional, and on the other hand 60.2% of Divorced women and 39.8% of women with emotional Divorce, Had a modern gender socialization. According to the results of Chi-square test, there is a significant relationship between the type of gender socialization of women, gender values, gender inequality and power relations with the type of Divorce. Accordingly, women with emotional Divorce have a more traditional outlook than Divorced women.

Emotional Divorce, according to psychologists, is an undeclared separation that results in vanishing the sexual pleasure from each other because of the rupture of the couple’s emotional relationship. This type of Divorce is not officially recognized in jurisprudence and law, but jurisprudential and legal laws may give some insights about it. From the jurisprudential point of view on adultery, a married man (moḥṣin) is the man who is married and a married woman (moḥṣina) is the woman who is married, subject to sexual pleasure between them. Article 227 of the Penal Code, by prescribing this criterion, refers to some examples of marriage rupture that are not possible in the case of their existence. The present research is intended to investigate the role of emotional Divorce in the decline of the state of being married (iḥṣān). It is assumed that emotional separation is an example of the fall of the state of being married that can play a role in determining the verdict.

This research is to explain and criticize the mentioned views and clarify the legal nature Khulea Divorce. Also we aim to prove the theory of its being unilateral juridique act.

From long ago Divorce has been accepted in laws and cultures with certain limits and constraints. Also in Islam Divorce has got specific sentences and conditions and religious scholars have spent centuries to investigate and explain it. The fact that civil laws are derived from religious orders has not been ignored on the matter of Divorce and includes those orders derives from jurisprudence scripts, although we sometimes observe silence and legal gaps or ambiguity in legal acts and this fact is seen throughout some cases of Divorce, including mandatory Divorce and minor Divorce which their nature and orders have been clearly described, but the law has kept silence on determining its origin and type. For that matter and to solve problems and commentary on legal acts on this subject, reviewing from jurisprudence way and its implementation to the low has been a big help and has short its similarities and differences. This article has been edited for that purpose and acknowledges mandatory Divorce as revocable and minor Divorce as irrevocable.

It is natural for couples to have disagreements because of personal differences, but this natural disagreement should not be so much as to shake the foundation of family. Thus, as Quran recommends us in chapter Nisa' [women], after the emergence of the symptoms of disagreement, a family peace court should be formed to solve the problem. In the Iranian law, this is called jurisdiction of Divorce to which the law maker should pay attention although there are deficiencies in the law. This paper deals with the foundations of jurisdiction, the development of law-making in jurisdiction, a study of the present law of jurisdiction, and an elaboration of legal impairments in the Iranian law. Then Iran is compared to Egypt, Iraq, and Syria in this respect. Finally, the paper suggests that the judiciary establish a sufficient number of branches for jurisdiction, along with family courts, composed of legal experts, family counselors, and psychologists to help courts to solve family disagreements.

This article studies emotional Divorce and the sociological factors effective on it in the city of Tehran. The statistical population of the research includes all the families residing in the city of Tehran and the sampling methodology is two-stage random and cluster sampling method. The theoretical framework of the research is a combination of the theory of structural functionalism and the theory of globalization of Anthony Giddens in the family domain. The methodology of the research is survey methodology and the data are gathered by researcher-made questionnaire. The results illustrate that the variables of ‘the discipline within family’ with -0.698, ‘the hierarchy of power in family’ with 0.631, and ‘the social capital in family’ with 0.563, have the most meaningful relationship with the amount of emotional Divorce. Also the regression results of the research show that the independent variables of the research explain almost 0.665 of the variance and changes of emotional Divorce.
